Terms of Use

Clear responsibilities for professional access, reference materials and preparation tools.

1. About these terms

These Terms of Use govern the Kiwi Prescriber Portal at kiwiportal.ca, operated by Kiwi Pharmacy & Wellness (Kiwi, we, us). They apply when you select the agreement checkbox and continue. If you do not agree, do not enter the protected portal; contact us about another way to communicate.

The portal provides approved professionals and Kiwi staff with reference materials, administrative tools and browser-based prescription preparation. It is not a patient chart, an emergency service or an electronic prescription-transmission service. Do not use it for urgent clinical communications.

2. Eligibility and account security

Access depends on Kiwi's review and the permissions assigned to your role. Prescriber access requires appropriate current professional credentials. Clinic staff may use only the features authorized for their own role; assisting a prescriber does not transfer prescribing authority.

Provide accurate professional and clinic information and tell Kiwi about changes affecting your eligibility. Use your own account and take reasonable steps to protect your credentials and device. Do not share passwords, activation links, security codes or another person's signature. Report suspected misuse promptly.

Where available and enabled for your account, Google or Microsoft sign-in establishes identity only. It does not verify professional eligibility, approve an application or expand your permissions.

3. Reference materials and professional judgment

Reference materials support professional work. They are not an individual patient assessment, personalized medical advice or a substitute for independent professional judgment. The treating professional remains responsible for checking current evidence, product information, scope of practice and the patient's circumstances.

A catalogue entry, search result, template or rule-check result does not establish that a preparation is approved, available, lawful or appropriate in every situation. Do not treat draft or restricted content as released clinical guidance. If content appears incorrect or conflicting, stop relying on it and notify Kiwi without sending patient details.

Nothing in these terms removes Kiwi's own professional, privacy or legal responsibilities, or those of the treating prescriber or dispensing pharmacist. Portal access does not restrict a patient's choice of pharmacy.

4. Preparing, signing and sending forms

The preparation tool creates a PDF on your device. Before using it, the responsible prescriber must review all fields, calculations, directions, patient details and signatures, and confirm that the form and signing method meet the requirements of the intended workflow. A signature drawn in the browser is not a guarantee that a particular prescription meets applicable signing or controlled-substance requirements.

The portal does not fax or electronically transmit prescriptions. You and your clinic must use an approved transmission channel, confirm receipt where necessary and keep the required clinical record in the appropriate system. A preparation reference or history entry does not prove that a prescription was received, accepted, dispensed or delivered.

Only the authorized signatory may apply their signature. Protect downloaded files and any signature saved in your browser. Use the removal control or clear site storage when appropriate, and do not save a signature on a shared or untrusted device.

5. Privacy and information boundaries

The Privacy Policy explains portal information handling. Accepting these terms does not authorize marketing or unrelated uses of personal information and does not waive privacy rights.

Enter patient-identifying information only in the designated browser-local preparation fields. Do not put patient information, prescriptions or chart extracts into access requests, administrative notes, support email, campaign uploads or other server-submitted fields.

You and your clinic remain responsible for lawful handling of local files and devices. If sensitive information is entered in the wrong place, stop the affected activity and contact Kiwi without repeating that information.

6. Permitted use and ownership

You may use the features and materials made available to your role for legitimate professional work, including using supplied forms in your authorized workflow and downloading material where permitted. Follow any notice attached to the material.

Kiwi and the relevant authors or licensors retain rights in the software, branding and reference content. Do not resell or publicly redistribute restricted materials, remove attribution or present altered material as Kiwi-approved. You retain rights in your own lawful content; Kiwi may process it as needed to provide and protect the service and as described in the Privacy Policy.

Do not bypass access controls, impersonate someone, falsify credentials or records, introduce malicious code, access another user's information without authority, or use automation that compromises security, availability or content restrictions. Nothing here limits a use permitted by applicable law.

7. Availability, providers and fees

Features and content may change. Maintenance, outages or security response can interrupt access. Do not rely on the portal as your only copy of a required clinical record or as the sole means of urgent communication. Kiwi will give notice of material planned interruptions where reasonably practicable.

External services may have their own terms and privacy practices. A link is not by itself an endorsement, and use of providers does not remove Kiwi's own obligations.

These terms do not authorize a charge, subscription or recurring payment. Any future paid service requires separately disclosed pricing and payment terms accepted before a charge. Access is not conditional on prescribing or referral volume.

8. Suspension, closure and changes

Kiwi may restrict access where reasonably necessary for security, loss of eligibility, misuse or legal obligations. Immediate action may be needed to protect people or information. Where appropriate and lawful, Kiwi will explain the reason and provide a way to request review.

You can request account closure through the contact below. Closure ends access but does not immediately erase every record or downloaded file. The Privacy Policy describes retention and the limits on deletion.

Revised terms will identify a new version and be presented for acceptance before further protected portal use under that version. They do not create retroactive consent or permission for unrelated information uses. You can read the public policies, sign out or access account-security controls without accepting a new version.

9. Responsibilities and disputes

Kiwi does not promise uninterrupted service, error-free or always-current reference material, or a particular clinical, operational or financial result. This does not remove duties imposed on Kiwi by law or professional standards.

Nothing in these terms excludes liability that cannot lawfully be excluded, waives statutory rights or prevents a complaint to a professional college, privacy regulator or other competent authority.

Subject to any mandatory law that applies, these terms are governed by British Columbia law and applicable federal Canadian law. Raise concerns with Kiwi first where practical; this does not prevent urgent relief or the exercise of legal rights. If a provision cannot be enforced, the remaining provisions continue to the extent permitted by law.
